# A to Z Landscaping – Terms of Service

Effective Date: March 1 2026

By requesting services from A to Z Landscaping, the client acknowledges and agrees to the following Terms of Service.

## 1. Organizational Purpose
A to Z Landscaping operates as a community-focused not-for-profit organization dedicated to improving neighborhoods while providing opportunities for high school and college-aged young men to learn valuable trade skills in landscaping, outdoor construction, and property improvement.

All moneys received support operational costs, skill training programs, and community initiatives such as the Lawn Run Program, which provides free landscaping services to individuals in the community who cannot afford yard work.

## 2. Estimates and Suggested Donation Amounts
All estimates provided by A to Z Landscaping represent good faith approximations of the suggested donation amount based on the visible conditions of the property at the time of evaluation.

Suggested donation amounts may change if:

- Additional labor becomes necessary 
- Hidden obstacles are discovered 
- Soil or ground conditions differ from expectations 
- Weather conditions delay or complicate work 
- Additional materials are required 
- The project scope changes at the request of the client 

Any additional labor, materials, or time required may result in an adjustment to the total suggested donation amount.

## 3. Deposits
Any deposits collected are used to reserve scheduling, labor allocation, and materials for a project.

All deposits are considered non-refundable donations and will not be returned under any circumstances.

## 4. Project Cancellation
If a client cancels a project after work has begun, the entire originally quoted suggested donation amount becomes immediately due regardless of the level of project completion.

This is due to labor scheduling, equipment use, material procurement, and lost scheduling opportunities for the organization.

## 5. Client Responsibility for Site Conditions
The client is responsible for identifying and clearly marking any underground or hidden items including but not limited to:

- Underground utilities 
- Irrigation or sprinkler systems 
- Invisible fencing 
- Landscape lighting wiring 
- Drainage systems 
- Septic systems 
- Water lines 
- Any buried structures or installations 

A to Z Landscaping is not responsible for damage to underground or hidden features that were not clearly marked, disclosed, or visible prior to work beginning.

## 6. Property Damage Limitations
While reasonable care is taken during all work, landscaping and outdoor services involve equipment, digging, grading, and natural environmental variables.

The organization is not responsible for damage to items that were:

- Not disclosed to the organization 
- Not visible or reasonably identifiable 
- Improperly installed or buried 
- Located beneath the surface without proper marking 

## 7. Weather and Environmental Conditions
Outdoor work is heavily dependent on weather and environmental conditions.

A to Z Landscaping reserves the right to delay, pause, or reschedule work due to:

- Weather conditions 
- Safety concerns 
- Soil conditions 
- Environmental hazards 

All project timelines are approximate estimates and are not guaranteed.

## 8. Quality of Work
All work will be performed to the best ability of the organization given existing property conditions, weather, available materials, and industry standards.

Because landscaping involves natural materials and environmental conditions, specific outcomes or appearances cannot always be guaranteed.

## 9. Donations
All moneys received by A to Z Landscaping are received as voluntary donations that support the organization’s mission, operational costs, and community programs.

Failure to provide the agreed suggested donation amount may result in:

- Late fees 
- Collection activity 
- Legal action to recover unpaid balances 

The client agrees to be responsible for any collection costs, legal expenses, and court fees associated with recovering unpaid balances.

## 10. Project Modifications
Any requested modifications to the original project may result in:

- Additional labor requirements 
- Additional materials 
- Schedule adjustments 

Such changes may increase the final suggested donation amount.

## 11. Right to Refuse or Stop Work
A to Z Landscaping reserves the right to refuse or discontinue work if:

- The property becomes unsafe 
- Conditions differ substantially from what was represented 
- The client behaves in a hostile or abusive manner 
- The agreed donation terms are not honored 

If work is discontinued under these circumstances, all labor, materials, and time allocated remain due under the originally agreed suggested donation amount.

## 12. Limitation of Liability
To the fullest extent permitted under Ohio law, A to Z Landscaping shall not be responsible for:

- Indirect damages 
- Incidental damages 
- Loss of property value 
- Loss of use of property 
- Consequential damages 

Any liability, if determined, shall not exceed the total amount of moneys received by the organization for the services performed.

## 13. Agreement to Terms
By requesting services, approving an estimate, signing a proposal, submitting a deposit, or allowing work to begin, the client acknowledges that they have read, understood, and agreed to these Terms of Service.

## 14. Property Access and Liability
The client grants A to Z Landscaping permission to access the property for the purpose of completing the requested services.

The client acknowledges that landscaping work involves equipment, vehicles, and physical labor that may result in minor ground disturbance, ruts, soil compression, or similar conditions, especially during wet or soft ground conditions.

The organization shall not be held responsible for minor surface disturbances that occur as a normal part of landscaping work.

## 15. Material and Natural Variation Disclaimer
Landscaping materials such as:

- Mulch 
- Stone 
- Gravel 
- Plants 
- Soil 
- Wood products 

may vary in color, texture, size, and appearance due to natural variation, manufacturing differences, or supplier changes.

A to Z Landscaping does not guarantee exact color matches or identical material appearance, and such variations shall not be considered grounds for dispute or reduction of the suggested donation amount.

## 16. Acts of Nature / Force Majeure
The organization shall not be held responsible for delays or changes in project timelines caused by events outside its control, including but not limited to:

- Severe weather 
- Flooding 
- Storms 
- Natural disasters 
- Equipment failure 
- Supply shortages 
- Labor shortages 

Such events may delay project completion without penalty to the organization.

## 17. Photo and Media Use
The client grants permission for A to Z Landscaping to photograph and document the property before, during, and after services are performed.

These images may be used for:

- Marketing 
- Educational purposes 
- Social media 
- Promotional materials 

No personal identifying information about the client will be shared without permission.

## 18. Abandoned Projects
If a project is delayed or abandoned due to client inaction, lack of communication, or refusal to continue agreed arrangements, the organization reserves the right to terminate the project and retain any deposits or donations received, while still collecting any remaining balance owed for labor, materials, and scheduling commitments.

## 19. Chargeback Protection
By agreeing to these terms, the client agrees not to initiate payment disputes or chargebacks with financial institutions without first contacting A to Z Landscaping and allowing reasonable opportunity to resolve the issue.

Improper chargebacks may result in the organization pursuing collection efforts and legal remedies to recover moneys owed.
